Welcome to NameSplit. By using our website and services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Acceptance of Terms

By accessing or using the NameSplit service, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you are prohibited from using this service.

2. Description of Service

NameSplit provides an automated analysis of personal names based on public statistical data. This service is provided for informational and convenience purposes only. We do not guarantee the absolute accuracy of any name analysis, as naming conventions vary widely across cultures and individuals.

3. Fair Use and Restrictions

You agree to use NameSplit only for lawful purposes. You are prohibited from:

• Using the service for any automated data scraping or mass harvesting of naming data, whether via the website or the API.
• Using the API to build derivative datasets, train machine learning models on our output, or re-sell access to the API responses.
• Attempting to bypass any security measures, including our bot protection systems.
• Using the service to process names in a way that is intended to harass, abuse, or harm individuals.
• Submitting inappropriate or profane content for analysis.

API subscribers specifically agree that each API call is made on behalf of a legitimate, individual name-lookup use case and not as part of any bulk or automated extraction pipeline.

4. Disclaimer of Warranties

NameSplit is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely accurate. Use of the service is at your own risk.

5. Limitation of Liability

In no event shall the operators of NameSplit be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the service, even if we have been notified of the possibility of such damages.

6. Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, the service with or without notice. We may also update these terms at any time. Your continued use of the service after such changes constitutes acceptance of the new terms.

7. API Subscriptions and Payments

Access to the NameSplit API is provided on a subscription basis. By completing a subscription purchase you agree that:

• Subscription fees are charged at the start of each billing period (monthly or every 6 months) and are non-transferable.
• Your API key is delivered digitally to the email address associated with your payment. You are responsible for keeping it secure.
• Each subscription grants access to one API key. Attempting to hold multiple concurrent active subscriptions for the same email address is not permitted and will result in automatic cancellation and refund of the duplicate.
• Your subscription renews automatically until you cancel via the customer portal. You may cancel at any time; access continues until the end of the current paid period.

8. Right of Withdrawal and Refund Policy

If you are a consumer in the European Union or European Economic Area, you ordinarily have a 14-day right of withdrawal from contracts for digital services concluded remotely.

Waiver of withdrawal right: By completing your purchase you expressly request that performance of the service begins immediately upon payment and you acknowledge that you thereby lose your right of withdrawal once the API key has been delivered to your email address, in accordance with Article 16(m) of Directive 2011/83/EU.

No refunds after delivery: Because the digital service (API key access) is delivered immediately and consumed upon receipt, we do not offer refunds once the key has been issued, except where required by applicable law or in the following cases:

• Duplicate accidental subscription — automatically detected and refunded in full within minutes.
• The service was not delivered due to a technical fault on our side — contact [email protected] within 14 days.

Outside the EU, refunds are issued at our sole discretion.

9. Governing Law

Any claim relating to NameSplit shall be governed by the laws of the jurisdiction in which the service operator is based, without regard to its conflict of law provisions.
